Bugging and Tape Recording Conversations in Arizona: Is it Legal?

By Trent Wilcox Lawyers often receive inquiries about the legalities of recording phone or other conversations in Arizona. In particular, the issue frequently arises in family law cases where child custody is at issue. Related to the recording issue is the “bugging” issue. There are a number of variables that affect the answer to the central question, whether it is legal to either record or even bug conversations. First, bugging and recording are two different issues under Arizona law, often related, but also potentially very different under the law. Second, the laws regarding bugging and recording vary significantly by jurisdiction so what is legal in one state may be illegal in another. As well, the federal law may vary from state laws. The following is a very brief analysis of the bugging and recording law in Arizona: A. Bugging, otherwise known as wiretapping, typically means placing a device on a phone that allows one to eavesdrop on a conversation or other transmission. Bugging by a private party is considered illegal almost all of the time for two reasons primarily: First, it allows someone to listen to a private conversation between two or more unsuspecting parties. Second, bugs are usually placed without permission so you have a number of infractions inherent in such trespass-like activity. If you suspect someone has placed a bug on your phone or other device, you should call the police. B. In the case of a telephone or in-person conversation, recording simply means making a copy of the conversation between two or more people. Recording is illegal in Arizona if NO party to the conversation knows that the conversation is being recorded. However, in Arizona, and this varies by state, if one party to the conversation knows that the conversation is being recorded, it is not illegal. Thus, if someone tape records a phone call or conversation involving him/herself and another person, even one who is unaware of being recorded, that’s legal in Arizona. If the same person taps into a phone line and records a conversation between two people who are unaware they are being recorded, it is ILLEGAL. Arizona and federal law are similar in this respect; however, recording conversations is illegal in certain other states unless all parties know of the recording and consent. There may be some cross-jurisdictional issues involved when tape recording a conversation across state or national boundaries. Prior to tape recording, I recommend that you consult an attorney in the appropriate jurisdiction. In summary, bugging/wiretapping is always illegal while tape recording is legal in Arizona as long as one party to the conversation is aware the conversation is being recorded. How Open Are You With Your Beloved?

If we are not totally honest and open with our beloved, that means we are not sure about our relationship. That means that we dont have confidence in each other. That means that the relationship is fragile. Why talk about such relationship, which is still fragile. Such a relationship will break for some or other reason. A strong relationship can take any storm. In a strong relationship, we are ready for some disagreement but know that ultimately things will be same as before. It is like a child who has got totally soiled. Mother may scold the child but it will be same as before within half an hour. That is a strong relationship. If you hide vital facts about your past from your sweetheart, you will always suffer from the guilt and worry about hat if he/she gets to know about that. That is not a happy relationship. Such relationships cause stress, rather than giving any pleasure. To get pleasure, have confidence, tell your partner everything about your past, and expect that they will not only understand but also comfort you about that. MBA Rankings

As an effective and conventional judging system, MBA ranking contributes to almost all leading business schools and business related programs. Online Dating or Bars

What would happen is that I would reach a slump in the internet scene and then focus solely on bars and clubs, and when I reached a slump there I would go back to the internet. But in between all that I had success with both so I was forced to conclude that both work. It’s also more fun if you do both. You get together with a girl from the internet and you can talk about the fun you had the other night at the club. In both cases you are dealing with people, and one can make sense of the other. There is a balance though. If you focus on either one too much you will burn out. So mix it up. Words Do Hurt Me

By Suzette Hinton Sticks and stones may break my bones, but words will never hurt me. Thats a crock! An absolute crock! Whoever wrote this didnt have a clue. I concur with Robert Fulghum, US author and Unitarian clergyman, who said, Sticks and stones will break our bones, but words will break our hearts… Many of us are getting the sticks and stones of life now because of the pain of words ill-spoken. Words like your momma wont nothing and you wont be nothing either wounds our self esteem. How can you esteem yourself, if people whom you respect or have authority afflict you with such words? Its even more disheartening when you succeed in life despite those words yet you cannot enjoy it because something inside of you feels unworthy. Youve achieved but you feel like a fraud. It wasn’t enough. I have a theory. If you have to prove something, then something inside of you is undecided about your value. At a deep level, you arent sure if you are worthy. However, instead of facing your pain, you seek to achieve something to prove you’re okay. The hurting words are no longer outside of you, but are inside your head taunting you, bullying you, criticizing you. Youve become your own abuser. I remember the pain of words spoken. My mom had no malicious intent whatsoever. My sisters and I were often invited to sing on programs at church. Despite the adulations of others, my mother never ever expressed any pride in our talents. When people would say, Alice, I know youre proud of your daughters she would shrug it off. I cant remember but I must have asked her why she did that because I recall her response, I dont want you to grow up thinking you are so much. What she meant was she didnt want us to grow up snooty or arrogant or condescending because of our talent. But it affected my self image in a negative way. It wasnt evident immediately. In fact, it wasn’t until college that I become aware of the pain. I was romantically involved with a young man. He was funny and charismatic. We had a great time together. The defining moment came when we went to a church event. The people at the church knew me. I got goo-gobs of attention, hugs, and kisses. I enjoyed it. Noticing that my friend was seated, I tried to include him by introducing him and inviting him to join me. He refused. During the ride back home, he sulked. He accused me of being Ms. Popular. But what really stung was, you would do anything for attention wouldnt you? Those words push the play button of my mothers original words. Immediately, I tried to convince him that I wasn’t the bad person he was making me out to be. I felt responsible and apologized profusely. After all, it wasn’t his fault. It was my fault that I had hurt him so badly that he wouldn’t believe me. He continued to hurl verbal accusations that put me down even further. I felt worse and worse. I called him repeatedly. When he’d finally answer, he was cold and distant. I even drove to his house. He told me to leave him alone and exploded angrily. He went for broke! He finally yelled it was over and he didnt want a girl like me. I was devastated. I turned on myself. In my eyes, I was a failure. I messed up. Now, I didn’t have the man I adored because of me. My mother didnt want me to be Miss High and Mighty and I had failed. I hurt. I hurt so bad. I was a bad girl. I hurt someone that I loved. I kept telling God that I didnt mean to be that way. I desperately asked God to change me. Words do hurt. Blinded by his own pain, my boyfriend harmed me. Blinded by her own pain, my mother’s words had harmed me. Damaging words can become internalized and can position you in life as the abused or the abuser. But Truth sets us free. Truth spoke to my agonizing heart and reminded me of who I am and how irrefutably valuable I am. I was then ready to heal. Suzette R. How to Grow Bamboo

By Hans Dekker Bamboo is a mysterious and elusive plant that baffles taxonomists who try to contain it within a botanical class and gardeners who try to contain it within a limited garden space as they learn how to grow bamboo. For many years, bamboo was thought to be a primitive grass but recent DNA testing has shown it to be one of the most highly evolved forest grasses. There are over 1200 forms of bamboo that grow in a broad spectrum of color including the familiar green and gold as well as burgundy, blue and even black grasses. Some varieties of bamboo can grow up to a foot a day and ultimately reach 130 feet tall while the smallest bamboo cultivar attains only six inches of growth. The first step in learning how to grow bamboo is picking a cultivar and beginning to unravel its many mysteries. While most of us picture tall stands of green and golden canes growing in tropical bamboo forests, bamboo cultivars range from the temperate to the tropical. As well as diversity in cultivar, bamboo has over 1500 documented uses that range from use in construction to the making of acupuncture needles and from agricultural fodder to the making of musical instruments. Until they are cut, bamboos stems are properly called culms and not canes. In India bamboo plants are commonly called the “Wood of the poor” and in China the friend of the people”. To add to the confusion, a cultivar commonly sold as lucky bamboo isnt bamboo at all but a type of lily from the Dracaena family! Unluckily for bamboo, it has the reputation for being an invasive plant, growing from running rhizomes. Although this is true for some cultivars, the most cold-hardy plants dont run at all, but grow from well-behaved clumps with well-established root systems. One thing that bamboo cultivars do have in common is that they are perennial plants. As noted above, some bamboos varieties are temperate and some are tropical. Because its diversity, its easy to find a suitable cultivar when you want to learn how to grow bamboo. Bamboo cultivars range from those that grow indoors to outdoors, in a garden or in a container, in bright light or shade. Two considerations in knowing how to grow bamboo successfully are water and air. All true bamboos are grasses and wont grow in saturated soils. They also need air circulation to thrive. In fact, some bamboo growers raise the pots of their small cultivars on chopsticks to provide air circulation under the plant as well as around it. Large pots are often elevated with heavy dowels. The bamboo is a symbol of long life, strength and versatility for many cultures of the world. Unraveling its mysteries is a continuing source of enjoyment. Check with your local community colleges to see which software or professional courses they offer as continuing education, or towards secretarial or administrative certification. Get media attention for your business, not just during holidays but all year round. Sometimes imaginative stunts like appearing in a sleigh help. 3. Ask your prospects what they want and then provide services and products that give them what they’ve asked for. Focus: A Weight Loss Strategy

This is working out, this is getting fit, this is what it takes. As I sit and stretch between sets, my quads still reeling, I scan around the gym. I take in those around me. At this hour, there are few people willing to brave the cold mornings to make the run to the gym. There are two people working with some free weights near by. They are within earshot and while I am resting I listen to them complain about, work, relationships, their bosses, clothes, their bodies and their friends. The conversation flows from one topic to the next seamlessly and it is clear by their candor that they know each other well; that they have been friends and work out buddies for a while. What grabs my attention however, is not the meandering topics of their conversation, but the fact that conversation is occurring at all. I ponder this until I start on my second set. As my second set starts, all I can focus on is exercise; flexing my muscles against the weight. During the relatively short time it takes for me to run through my set and completely exhaust my quads, every action, every breath becomes an exercise in methodical control and economy. Every action I make is geared to the exercise at hand. When I finish and I reengage with the world, I come back to the two people and their on-going conversation. As they chat, they work through a routine of exercises that look habitual and ritualized. When they work their muscles, they go through the motions; intent more on the conversation and company then their bodies. There is a point to this. There is a myth, an urban legend if you will, that says going to the gym will make you lose weight. It is a logical extension of the same myth that says I need to go to the gym, I am out of shape. These two ideas have become synonymous with healthy lifestyles and fitness. For the two people I observed, simply being at the gym was enough to assuage their concerns for their physical health. The bottom line is that this is an illusion. To make yourself fit, you need to break your body down and force it to rebuild. The idea being that after the rebuild, you will be stronger and fit. This cannot occur by merely being in a gym, or as in the case with the talking pair, this cannot occur by going through the motions of working out. Before I get accused of being a fanatical meat head just understand that I carry an extra few pounds around my waist. All I know is that to really make progress, to have physical and visible results, you must have an impact on your body. The kicker is that they almost have it made. These people are at they gym early on a cold morning. They are committed to their weight loss goals. They go through the motions of their exercises like a well rehearsed dance routine. Clearly they want to achieve something with their bodies. If they just focused, and worked their bodies just a little more; enough, say, to deny them the ease of conversation, then the results would be tremendous. The whole point is that you have to be clear about what it is you want to accomplish. I know with every fiber in my being, that I will burn off the extra weight around my waist and that I will firm up my desk loving muscles. But I won’t do it by talking.
